/ OUR PROCESS

You were injured in an accident while visiting Florida. To pursue a lawsuit in a Florida Court, you need a Florida licensed attorney. We can be that attorney. Here’s our process...

1. CONTACT US permalink

Three ways to reach us:
a) Visit our Contact Page
b) Email: info@racohenlaw.com
c) Phone: 305-255-5488

2. SIGN AGREEMENTS permalink

If we both decide to move forward, we will have you approve and sign agreements electronically, which will make it easy for you.

3. INVESTIGATE YOUR ACCIDENT permalink

We’ll study what, when, where and how your accident happened and who is responsible.

4. DETERMINE AT-FAULT PARTIES & THEIR INSURANCE COVERAGE permalink

We’ll identify the parties responsible. It’s not just a single person at fault. For example, if you were hit by a ride share driver or a passenger in an ride share vehicle involved in a crash, we can seek recompense from Uber, Lyft, or other ride sharing companies. If you suffered a slip and fall at a mall, the independent janitorial maintenance company that caused the hazard may be better insured than the property owner. The goal is to determine the best course of action to obtain compensation for your related medical expenses, pain and suffering, disability, lost income, etc.

5. NOTIFY POTENTIAL DEFENDANT permalink

We’ll reach out to the defendant, let them know about this potential lawsuit and find out their insurance company and legal counsel. Don’t reach out to or negotiate with the defendant or representatives directly. It could have a negative impact on your case. This is why you have us. Let us handle it for you.

Follow the directions of your doctors, including all tests, surgeries, seeing recommended specialists, physical therapy, etc. Do what you are told to do to get better.

7. WORK WITH YOUR DOCTORS permalink

We’ll obtain all medical records and bills to keep track of your medical expenses.

8. NEGOTIATE permalink

Once you’re through with your medical treatment (and we know the extent of your medical expenses), we will engage the defendant through its insurance company or representatives and look to obtain an amount that adequately compensates you.

9. FILE THE LAWSUIT permalink

No settlement yet? We’ll take them to court. Insurance companies often try to stall as long as possible, using a potential court case as a way to intimidate less experienced lawyers. That won’t work with us. We are fully comfortable going to court (see our experience here) and fighting for what you deserve.

10. COORDINATE PROCEEDINGS permalink

We will oversee the:
a) Deposition - The opportunity for you to tell your side of the story.
b) Mediation - In Florida, before going to trial, the two sides must first meet with a mediator to see if they can work out a settlement.
c) Medical Exam - The insurance company has the right to have you examined by its own doctors.
d) Trial

You will need to be in person for all the above, so we will coordinate with you to make sure this is manageable for you.

11. TRY YOUR CASE IN COURT permalink

If we’re unable to settle and a jury needs to decide your case’s value, we’ll take your case to trial as we have done for many other clients.
